Sri Lankan Cricketer Danushka Gunathilaka Has Three Out Of Four Sex Assault Charges Withdrawn

The public prosecutor dismissed three of the four charges against Sri Lankan cricketer Danushka Gunathilaka in Downing Centre Local Court on Thursday. Danushka Gunathilaka is accused of sexually assaulting a woman in her house in Sydney’s eastern suburbs on November 2, last year.
Danushka Gunathilaka was arrested at his team hotel in Sydney’s CBD last year and charged with four counts of sexual intercourse without consent over the alleged incident during the T20 World Cup 2022. The 32-year-old is now facing a single charge of sexual assault, following the court decision.

According to police reports, Gunathilaka met the woman through the Tinder app in November 2022. The pair chatted several times before meeting each other for drinks and then going out for pizza. Later, the cricketer went to her house, and he choked her and raped her without a condom.
“He put one hand around her neck for 20 to 30 seconds and choked her. The complainant was too afraid to do anything,” the police facts claim, alleging he had choked her twice more.

“She tried to remove the accused’s hand by grabbing his wrist, but the accused squeezed tighter around her neck for a further 10 seconds. The complainant was fearing for her life and could not get away from the accused,” police allege.

“The condom was on the floor. The complainant was in shock, she did not feel safe saying anything to the accused out of fear of retribution,” the police facts claim.

“The complainant was clear that she did not consent to engaging in sexual intercourse without a condom. Further, the complainant did not consent to sexual intercourse that involved choking.”
Danushka Gunathilaka represented the nation in all three formats of the game in international cricket. The Southpaw made his international debut in 2015 and went on to represent the nation in eight tests, 47 ODIs, and 46 T20Is. Sri Lanka Cricket has suspended him from all forms of the game.
