Supreme Court Issues Notice To Ex-India Captain MS Dhoni In Arbitration Proceedings Against Amrapali Group

On Monday, July 25, 2022, the arbitral proceedings, which were commenced by former India National Cricket Team captain MS Dhoni against the Amrapali Group over a financial dispute, were stayed by the Supreme Court.

The forensic Auditors, which were appointed by the Apex Court, told the bench that Amrapali Group and Rhiti Sports Management Pvt Ltd (RSMPL) entered into “sham agreements” to “illegally divert” the money of the home buyers.

The Rhiti Sports Management Pvt Ltd (RSMPL), which is the management that manages the endorsements of legendary captain MS Dhoni, was paid an amount of INR 42.22 Crore during 2009-2015.

MS Dhoni, who led India to 50-over World Cup, 20-over World Cup and Champions Trophy wins, had moved to the Delhi High Court. In October 2019, the court, to arbitrate the financial dispute between the Ex-India captain and the firm, appointed former judge Veena Birbal as the sole arbitrator.

On Monday, the bench, which comprised of justices UU Lalit and Bela M Trivedi, was informed about the pending arbitration proceedings. The court in the order asserted that to secure the interests of the home buyers a court receiver has been appointed to make sure that the housing projects get completed in time and the houses are provided to the buyers.

In the notice, which was issued to the legendary India captain MS Dhoni, the Supreme Court requested Justice Birbal “to hold her hands” and not proceed with the arbitration.

“In view of these, it would be extremely difficult for the receiver to defend and take care of such litigations…It cannot be expected that the erstwhile management or anybody else can represent the Amrapali group of companies before the learned sole arbitrator,” the bench said.

Meanwhile, MS Dhoni, in 2019, moved to Supreme Court to seek the protection of his ownership rights on an over 5,500-square feet penthouse, which was booked by him in a project of Amrapali Group a decade ago.

Also, Dhoni was provided with a huge amount of money to become the brand ambassador of the real estate firm, told Lawyer M L Lahoty. The Lawyer added that “we had at that stage argued that the amount was to be recovered” and “the issue of retrieving of money is going on in the apex court.”

Talking about Dhoni, who retired from international cricket in 2020, is regarded as one of the most successful players ever to play international cricket. Although he has retired from international cricket, he still plays for the Chennai Super Kings (CSK) in the Indian Premier League (IPL) and is expected to play in the 2023 edition of the tournament.
