Massive update on MS Dhoni defamation case, suit termed 'not maintainable' by ex-India captain

Veteran Indian wicketkeeper and former captain MS Dhoni’s counsel while speaking to the Delhi High Court in a defamatory case filed against him by ex-business partners stated that it was not maintainable, as per PTI.
The Delhi High Court has refused to give an order into the matter against Dhoni and has also stopped several media organizations and social media platforms from posting any false or defamatory content against the plaintiffs of the case. The step has been taken so that their reputation and dignity are not harmed.
Mihir Diwakar and his wife Soumya Das, have filed a defamation case against MS Dhoni alleging that the former cricketer has made false and defamatory posts and statements about the duo gaining INR 15 crore from MSD. They have also filed a case against Meta, Google, X, 30 news organizations, and various news portals.
What is the defamatory case filed against MS Dhoni?
MS Dhoni‘s legal counsel who appeared before the court stated in the Delhi High Court and also submitted the stance of MS Dhoni that the case against him is not maintainable and he has already filed a case against the couple in Ranchi.
The case has been filed in Ranchi’s lower court against Mihir Diwakar and Soumya Das, who are also the directors of Aarka Sports, which is a sports management company. Dhoni’s legal council further added that they have filed a case against the duo in the criminal offense under Section 406 (criminal breach of trust) and 420 (cheating) of the Indian Penal Code.
The lawyers who appeared on behalf of the plaintiffs stated that he only wanted fair reporting by the media organizations as the messages and statements that were made against them have already considered them as thugs and thieves. Advocate Sidhant Kumar who came to represent the media houses debated that the case application is not maintainable and also quoted the previous order which mentioned that until and unless specific allegations are not proved against both the defendants no case can be made out of this.
During the hearing, an issue of the lack of jurisdiction of the court also came into the limelight when the plaintiff’s counsel was asked to prove their allegations in the next hearing which is set to take place on April 3.
Earlier in a press conference that was held by Mihir Diwakar and Soumya Das, they gave their inputs against the case that has been filed by MS Dhoni. As per the lawyer, MS Dhoni filed a criminal case against the duo in which they were alleged to duped MSD of around INR 16 crores and also not honour the contract that was signed to establish cricket academies.
Apart from the legal field, MS Dhoni will be back on the cricket field during the Indian Premier League 2024. MSD will once again be seen leading the Chennai Super Kings and will want to win the fourth title for the franchise. The IPL 2024 can be the last of MS Dhoni’s IPL career and he will want to give a fairytale ending to it for the same.
